Performance Agreement

Every booking includes this performance agreement. After you request a date, it is delivered by email within 48 hours with your show details filled in, ready to review and sign electronically.

3. Fee and payment

1. Performance fee: $ (San Antonio / Austin / San Marcos $800 · Dallas / Houston $1,200 · Out of state $4,500).
2. A deposit of 50% is paid at booking through the XNIGHTSTARR checkout. The date is held once the deposit is paid and this agreement is signed.
3. The remaining 50% is due no later than 7 days before the performance, unless both parties agree in writing to payment on the day of the show before the set starts.
4. Out-of-state engagements: Purchaser also covers round-trip travel and one night's lodging for the Artist and up to crew, unless stated otherwise here:

4. Production and equipment

The Artist arrives 2–4 hours before the set for setup and soundcheck. Purchaser provides, at minimum, the equipment listed in the booking request: a working PA, vocal microphones, monitors and a playback / DJ setup, plus a sound engineer for the set. Equipment notes:

5. Cancellation

1. If the Artist cannot confirm the date, the deposit is refunded in full.
2. If the Purchaser cancels 30 or more days before the show, the deposit is refunded less payment processing fees. Inside 30 days, the deposit is kept by the Artist.
3. If the Artist cancels after confirming, all money paid is refunded in full.
4. Neither party is responsible for cancellation caused by events outside their control (severe weather, venue closure, government order, serious illness). In that case the parties first try to reschedule; if no new date works, the deposit is refunded.

6. Promotion and recording

Purchaser may use the Artist's name, approved photos and logo to promote this event. Audio or video recording of the full set for commercial use needs the Artist's written consent. Fans filming on phones is fine.

7. Safety and conduct

Purchaser provides a safe performance area and reasonable security. The Artist may stop the set if conditions are unsafe, without losing the fee.

8. General

This agreement is governed by the laws of the State of Texas. Changes must be in writing and agreed by both parties. Signatures may be electronic.
