Custom Beat Agreement

Every custom beat order includes this agreement. After you order, it is emailed to you with your beat with your beat details filled in, ready to review and sign electronically.

1. Parties

This agreement is between XNIGHTSTARR ("Producer") and ("Artist").

2. The beat

The Producer creates an original instrumental for the Artist ("the Beat") based on the brief given at checkout. Working title: · References / mood:

3. Payment and delivery

1. The full fee is paid at checkout.
2. The Producer delivers the Beat within 24–72 hours of the order, as a WAV master and an MP3. Exclusive orders also get the beat's track-out stems where the session has them.
3. One update is included, requested through the update form. Further updates or a new beat are quoted separately.

4. Non-exclusive license ($50)

1. The Artist may record one song over the Beat and release it on streaming services, sell it, perform it live and use it in one music video.
2. The Producer keeps ownership of the Beat and may license it to other artists.
3. The Artist cannot register the Beat alone with Content ID or resell or license the Beat itself.

5. Exclusive license ($100)

1. The Beat is licensed only to the Artist. The Producer will not sell or license it to anyone else and removes it from sale.
2. The Artist may record, release, perform and monetize songs over the Beat without limit on streams, sales or videos, including sync placements of the Artist's song.
3. The Producer keeps the copyright in the underlying composition of the Beat unless both parties agree otherwise in writing.

6. Credit and publishing

Releases using the Beat credit "Prod. XNIGHTSTARR". The Producer keeps 50% of the writer's share and 50% of the publishing for the composition of each song made with the Beat, unless stated otherwise here: . Both parties register their shares with their performing rights organizations.

7. Refunds

Before work on the Beat starts, the Artist may cancel for a full refund. After the Beat is delivered, the fee is non-refundable except where the Producer fails to deliver.

8. General

This agreement is governed by the laws of the State of Texas. Changes must be in writing and agreed by both parties. Signatures may be electronic.
