Custom Non-Exclusive Song Agreement

Every custom non-exclusive song order signs this agreement on the order form, together with the split sheet, before checkout. A filled-in copy of what you signed, with your name, order, price and delivery date, is emailed to you and to XNIGHTSTARR.

1. Parties

This agreement is between XNIGHTSTARR ("Producer") and , the person named on the order form ("Client"), artist / brand name .

2. The songs

The Producer writes, records and produces original song(s) for the Client ("the Songs", or "the Song" for a single-song order) from the brief given on the order form. Brief / use:

3. Payment, delivery and updates

1. The full fee is paid at checkout, after this agreement and the split sheet are signed.
2. The Producer delivers the Songs within 5–7 days of payment, each as a finished master (WAV + MP3). For a 5-song order, all five Songs are delivered within the same 5–7 days.
3. One update per Song is included, requested through the update form. Further updates or new songs are quoted separately.

4. Non-exclusive license

1. The Client may release each Song on streaming services, sell it, perform it live, monetize it and use it in music videos, social content and for their brand or project, worldwide and with no time limit.
2. The license is non-exclusive. The Producer keeps ownership of each Song (the master recording and the composition) and may release, sell or license it to others, including in the XNIGHTSTARR catalog.
3. The Client cannot register a Song alone with Content ID or any similar content-matching system, claim sole ownership of it, or resell, sublicense or transfer the Song itself to someone else.
4. If the Client wants a Song exclusively later, the Producer may quote an exclusive license separately, in writing.

5. Credit, split sheet and PRO registration

Releases using a Song credit "Prod. XNIGHTSTARR". Because the Producer writes and owns the Songs, the Producer keeps 100% of the writer's share and 100% of the publishing for each Song's composition, as shown on the signed split sheet, unless both parties agree otherwise in writing. The Producer registers the Songs with their performing rights organization (PRO).

6. Refunds

Before work on the Songs starts, the Client may cancel for a full refund. After delivery, the fee is non-refundable except where the Producer fails to deliver.

7. General

This agreement is governed by the laws of the State of Texas. Changes must be in writing and agreed by both parties. Signatures may be electronic: typing your full legal name and ticking the agreement box on the order form is your signature.
