Custom Song Agreement

1. Parties

This agreement is between XNIGHTSTARR ("Producer") and the person named on the order form ("Client").

2. The song

The Producer writes, records and produces an original song for the Client ("the Song") from the brief given on the order form.

Order type (as chosen on the form): Custom Exclusive Song · $500, or Full Song Production · $2,000.

3. Payment, delivery and updates

  1. The full fee is paid at checkout, after this agreement and the split sheet are signed.
  2. Custom Exclusive Song: delivered within 24–72 hours of payment as a finished master (WAV + MP3), with up to 5 updates requested through the update form.
  3. Full Song Production: lyric ideas and direction, beat and full production, and a session ready for mixing, on the schedule agreed after the order.

4. Custom Exclusive Song

  1. The Song is made only for the Client and is never sold or licensed by the Producer to anyone else.
  2. The Client may release, perform, monetize and use the Song in videos and for their brand or project worldwide.

5. Full Song Production

  1. The Song is built with the Client for the Client's release.
  2. Ownership of the composition and publishing is shared as set out in the signed split sheet.

6. Credit, split sheet and PRO registration

Releases credit "Prod. XNIGHTSTARR". Writer and publishing shares in the composition are those on the signed split sheet. Each party registers their own share with their performing rights organization (PRO) using the PRO details given on the split sheet.

7. Refunds

Before work on the Song starts, the Client may cancel for a full refund. After delivery, the fee is non-refundable except where the Producer fails to deliver.

8. General

This agreement is governed by the laws of the State of Texas. Changes must be in writing and agreed by both parties. Signatures may be electronic: typing your full legal name and ticking the agreement box on the order form is your signature.
